Terms of Service
Our terms of service are mentioned below:
- Definitions:
The meaning of the expressions and terms present in this agreement have been defined with their meaning stated right next to them. This will stay in effect unless stated otherwise.
1.1 Agreement means the T&C (terms and conditions) relevant to the service/package.
1.2 Company means the company providing the service.
1.3 Customer – A user or entity which is in an agreement with the company to receive services.
- The Service
2.1 Registration for the purchase or use of service by a customer means that they have accepted the Agreement and Terms of use. This also means that he/she has read the Terms and understands them properly. This also means that the customer is of legal age at the time of entering into an agreement. Any person who doesn’t agree to the terms and conditions of the agreement must refrain from buying/ the services.
2.2 A customer is liable for the call charges made by him/her based on the company records. In case of a difference between the call records of a 3rd party and the company records, preference will be given the company’s record.
2.3 A customer is responsible for safeguarding their account and informing the company if they want to discontinue the service or improper use. A customer will continue to pay and will be solely responsible for all the expenses of their account until proper disconnection.
2.4 The company reserves the right to modify assigned numbers via an advance notification.
2.5 All the prices shown on the website are in USD ($).
2.6 The service can not be used for emergency services.
2.7 The company only provides the right to use a number. It doesn’t mean any form of ownership rights! The rights for numbers are held by the company alone.
2.8 An internet connection is required to use the service.
2.9 Service Duration: Service agreement duration is 30 days and is renewed automatically unless stated otherwise.
2.10 At the end of the previous month, billing will be done.
2.11. Canceling of service: Service cancellation by the customer can be done by sending an email. The email must contain the phone number and the username to be canceled and sent to the support email.
2.12 For fraud prevention, the email’s return address must match the one held by the company in its records. Please request us to confirm your cancellation request.
2.13.1. Our ITC team will ensure and check to provide SPAM-free tag numbers to our customers, checked on Truecaller.com.
2.13.2. Local numbers which are canceled by the user and are found to present a SPAM tag on Truecaller.com will be charged three times (x3) its monthly cost of service (penalty fee) per number.
2.13.3. For each complaint, a 120$ handling fee will be charged to the customer’s account, per each complaint, if we receive a fraud activity complaint.
2.14. No refunds for the money deposited in the pre-paid account. It can only be used for calls.
2.15 All Calls starting with 1 (example, toll-free, emergency service, and more) will be billed as a call to the landline number for that destination.
2.16 Replacement of allocated numbers is done at no cost by our support team if found not to support the service they intend to provide.
2.17 Once the numbers are allocated, the ITC team doesn’t have any automated way to ensure the number remain functional. However, the customer has the right to test the allocated number, at any time and frequency deemed to be needed, report any issue found to our support.
2.18 Where applicable, the minimum incoming call duration is 60 seconds.
- Acceptable Service Use
3.1 A Customer agrees to use the website, software, and service only for purposes permitted by this Agreement along with any applicable laws and generally accepted practices in the relevant jurisdictions.
3.2 A Customer must not use the Service or allow others to use the service for the transition of inappropriate content. Inappropriate content means unsolicited material, spam, obscene and sexually explicit material, and content that violates Applicable Law or constitutes hate.
3.3. The service can not be used for auto-dialing, callback, extensive call forwarding, telemarketing, voicemail broadcasting, or fax or voice mail blasting purposes.
3.4. Customer agrees to indemnify the Company against any damage and/or cost and/or claim and/or expense and/or demand, including any made by a third party, arising out of the Customer’s or End User’s use of the service in violation of the Acceptable Use of Services, and all costs relating thereto, all of which will immediately be payable.
- Limitation of Liability
4.1. The Customer acknowledges that the Service is susceptible to interruptions by nature. The Service is provided on an “as is” with all faults, and that the Company does not undertake that the Service will be free of interruptions or available at all times.
4.2. Without derogating from any other provision herein concerning interruption and/or discontinuance of the Service, the Service may be interrupted owing to essential or maintenance works on any of the systems/infrastructures used to provide it.
4.3. The Customer acknowledges that some parts of the service are provided by 3rd parties over which, the Company has no control and that the Company shall not be liable for any act or omission of such third parties, and the Customer undertakes not to make any claim and/or demand against the Company with relation thereto.
4.4. Provision of the Service is subject to, among other factors, telephone line availability and the condition of the telephone devices used.
4.5. EXCEPT AS OTHERWISE SPECIFICALLY SET FORTH IN THESE TERMS OF USE, THE COMPANY (INCLUDING ITS OFFICERS, EMPLOYEES, AND ANY AFFILIATES) AND ITS SUPPLIERS DISCLAIM ANY AND ALL WARRANTIES WITH RESPECT TO THE SERVICE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
4.6. In no event shall Company (including its officers, employees, and any affiliates), or any of its suppliers or third parties providing services with relation to the Service be liable for: (a) any direct, indirect, punitive, special, consequential, or incidental damages, including, without limitation, lost profits or loss of revenue arising with relation to the use or inability to use the Service (including, without limitation, the inability to access emergency services via the Service), whether under contract, tort, negligence, or strict liability, even if the Company had been advised of the possibility of such claim or damages, or (b) any claim against the Customer by any third party.
- Lawful purposes
5.1. You acknowledge and agree to use any of the Company’s Websites or Services solely for lawful purposes. In this respect you may not, without limitation (a) intercept or monitor, damage or modify any communication which is not intended for you, (b) use any type of spider, virus, worm, trojan-horse, time bomb, or any other codes or instructions that are designed to distort, delete, damage or disassemble any of Company’s Websites or Services or the communication, (c) send any unsolicited commercial communication not permitted by applicable law, or (d) expose any other user to material which is offensive, harmful to minors, indecent, unlawful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, racially, ethnically or otherwise objectionable material of any kind, including, but not limited to, any material which encourages conduct that would constitute a criminal offense, violate the rights of others, or otherwise violate any applicable local, state, national or international law or otherwise objectionable.
You will be responsible for and indemnify and hold harmless the Company against any claim arising from any material that you post or transmit.
- Miscellaneous
6.1. The Company maximum liability to the customer or his beneficiary will be equal to the amount actually paid by the customer to the Company.
6.2. The Company reserve the right to modify this Term Of Service agreement. Modifications will apply to new and current customers as well.
6.3. The Company reserve the right to modify its prices upon its sole discretion. Notice of price changes will be given 30 days in advance.
6.4. This Agreement shall be construed and enforced in accordance with the laws of the country.
6.5. Shipping when needed, will be done insured and registered unless specified differently.
6.6. All offers are valid while supply lasts.
6.7. The Company reserves the right to change this Terms of Service at any time. Changes shall become effective within thirty (30) days of publication of the revised version on our website. Your continued use of your subscription after the expiry of the 30-day period shall constitute your acceptance to be bound by the terms and conditions of the revised Terms of Service policy.
GPRD compliance
1) Lawful, fair and transparent processing
ITC will process the personal data in a lawful, fair, and transparent manner. All processing will be based on a legitimate purpose. The ITC team will take responsibility and will not process data for any purpose other than the legitimate purposes. ITC will inform data subjects about the processing activities on their personal data.
2) Limitation of purpose, data, and storage
ITC will limit the processing of data, collecting only the data which is necessary and will not keep personal data once the processing purpose is completed. ITC will forbid the processing of personal data outside the legitimate purpose for which the personal data was collected. ITC will mandate that no personal data, other than what is necessary, be requested. The personal data will be deleted once the legitimate purpose for which it was collected is fulfilled.
3) Data subject rights
The customers have been assigned the right to ask ITC what information it has about them, and what ITC does with this information. In addition, a customer has the right to ask for correction, object to processing, lodge a complaint, and ask for the deletion or transfer of his or her personal data.
4) Consent
As and when the company has the intent to process personal data beyond the legitimate purpose for which that data was collected, clear and explicit consent will be asked from the customer. Once collected, this consent will be documented, and the customer will be allowed to withdraw his consent at any moment. Also, for the processing of children’s data, GDPR requires the explicit consent of the parents (or guardian) if the child’s age is under 16.
5) Personal data breaches
ITC will maintain a Personal Data Breach Register and, based on severity, the regulator and the data subject will be informed within 72 hours of identifying the breach.
6) Privacy by Design
ITC will incorporate organizational and technical mechanisms to protect personal data in the design of new systems and processes; that is, privacy and protection aspects will be ensured by default.
7) Data Protection Impact Assessment
To estimate the impact of changes or new actions, a Data Protection Impact Assessment will be conducted when initiating a new project, change, or product.
8) Data transfers
ITC has the accountability to ensure that personal data is protected and GDPR requirements respected, even if the processing is being done by a third party.
9) Data Protection Officer
When there is significant processing of personal data in an organization, ITC will assign a Data Protection Officer.
10) Awareness and training
ITC will create awareness among employees about key GDPR requirements, and conduct regular training to ensure that employees remain aware of their responsibilities with regard to the protection of personal data and identification of personal data breaches as soon as possible.
